Offers of Employment

If a foreign national intends to apply for an employer-specific work permit under the International Mobility Program (e.g. as an intra-company transferee), their employer or prospective employer will be required to submit an offer of employment (also known as an employer compliance application) to Immigration, Refugees and Citizenship Canada (Immigration Canada) before the foreign national can apply for a work permit.  

The Employer Portal 

Generally, an employer or prospective employer must submit the offer of employment online via their Employer Portal. If an employer or prospective employer does not have an Employer Portal, they are expected to create one for this purpose. When creating an Employer Portal, the employer or prospective employer must provide detailed information with respect to the company, including the following:

  • Canada Revenue Agency (CRA) business number; and
  • Business legal name and business operating name. 

Information Required for the Offer of Employment

When filing the first offer of employment, an employer or prospective employer or their authorized representative must provide additional information with respect to the company, including the following:

  • Business number;
  • Business legal name;
  • Business operating name;
  • Business telephone number;
  • Type of business;
  • Business details; and
  • Company representative and their contact details.

This information will be saved in the Employer Portal and used for subsequent offers of employment.

When filing an offer of employment, an employer or prospective employer or their authorized representative must provide detailed information with respect to the foreign national’s employment with the company, including the following:  

  • Foreign national’s name, gender, date of birth, country of birth, country of residence, citizenship, and passport number; 
  • Labour Market Impact Assessment Exemption Code being requested;
  • Explanation as to how the job meets the requirements of the exemption being requested;
  • Job title, the National Occupational Classification (NOC) Code, and the main duties of the job;
  • Qualifications required for the job (including education, training, and work experience);
  • Address of the work location;
  • Wage, number of work hours, overtime rate, and / or a description of an alternative compensation scheme; and
  • Vacation entitlement and benefits package (e.g. disability insurance, dental insurance, extended medical insurance, etc.).

The employer or prospective employer or their authorized representative must also agree to the Employer Declaration. 

After an offer of employment has been submitted, the employer or prospective employer or their authorized representative will be directed to pay a CAD$230 employer compliance fee. This fee must be paid online using a major credit card (Visa, MasterCard, or AMEX). 

After Submission of the Offer of Employment

After an offer of employment has been submitted, the employer or prospective employer or their authorized representative should receive an e-mail from Immigration Canada providing an offer of employment number (a seven-digit number starting with an “A”). If not, this number can be found in the Offer of Employment Que in the Employer Portal. The foreign national will be required to provide this number to the Canadian visa office or the Canada Border Services Agency (depending upon where they apply for their work permit) when they apply for their work permit. 

It is imperative that the information which is provided in the offer of employment is accurate and complete as Immigration Canada uses this information for the purpose of employer compliance inspections. An employer may be subject to an inspection to verify their compliance with certain conditions for a period of six years from the date on which the foreign national commences employment in Canada.
