Changes to the High-Wage / Low-Wage Thresholds

Under the Temporary Foreign Worker Program, there are significantly different requirements depending upon whether a position is classified as a high-wage position or a low-wage position. For example, if a position is classified as a low-wage position, the employer is required to target underrepresented groups (e.g. indigenous persons, vulnerable youth, newcomers, and persons with disabilities) when advertising the position.

If an employer is offering a wage which is at or above the provincial or territorial median hourly wage, the application must be submitted under the high-wage stream. Conversely, if an employer is offering a wage which is below the provincial or territorial median hourly wage, the application must be submitted under the low-wage stream.

Effective today, Employment and Social Development Canada has adjusted the provincial or territorial median hourly wages. As indicated in the Table below, all wages have increased expect for Nova Scotia which remains the same and Nunavut which has decreased by CAD$1.00 per hour.

Employers who are yet to file a labour market impact assessment application, including those currently completing the advertising and recruitment activities, will be subject to these changes.

New Federal Immigration Program for Rural and Northern Communities

Today, Immigration, Refugees and Citizenship Canada (IRCC) announced the creation of a five year Rural and Northern Immigration Pilot. The objective of this Pilot is to help small and rural communities meet local labour market needs and support regional economic development. This Pilot will provide a pathway to permanent residence for foreign nationals wanting to immigrate to small and rural communities in Canada. Communities that are interested in participating in this Pilot must submit an application, consisting of a Community Interest Form and supporting documents, to IRCC through a community-based economic development organization by 11:59 pm PST on March 1, 2019. Click on the caption above to read more about this Pilot.

Express Entry Draw - January 10, 2019

Immigration, Refugees and Citizenship Canada issued 3,900 invitations to apply (ITAs) for Canadian permanent residence under the Express Entry System today. The lowest score to receive an ITA today was 449 which is 10 points higher than the previous draw.

Our Year in Review

Aside from starting dRN Law LLP and the overwhelming support we have received from our clients in response, some of the highlights of our year included (in no particular order):

1. Obtaining work permits for some of the brightest people in the world to work on projects of national importance, such as the innovation of Canada’s agri-food industry, the enhanced development of Canada’s clean technology sector, and the diversification of Alberta’s economy;

2. Advising some high profile individuals, including a professional athlete, an internationally acclaimed artist, and family members of a former president with respect to various immigration matters; and

3. Obtaining refugee protection for multiple LGBTQ clients and an interreligious/interracial family who have suffered harm or are at risk of suffering harm in their home countries.

Looking back on this year, we are proud of the work we have done. Seeing the impact on our clients’ lives and the world around us is beyond gratifying.

During the holiday season more than ever, our minds turn to those who have made our progress possible. It is in this spirit that we say, simply but sincerely, thank you!

On February 1, 2018, Andréa de Rocquigny and Rebecca Norton founded dRN Law LLP. After working together at one of the world’s largest law firms for several years, we decided that we could better serve our clients by establishing our own law firm.

For many years, clients requested change with respect to the delivery of immigration legal services – more reasonable and predictable fees, easier access to lawyers, a faster resolution of matters, and a general sense from their lawyers that they cared.

We became frustrated by seeing absolutely no progress consistent with this important feedback. Therefore, we established dRN Law LLP where we combined top-tier legal training and experience with good, old-fashioned client service and compassion.

Our business model reflects a significant paradigm shift in the way in which immigration legal services are delivered and the response from our clients has been overwhelmingly positive. Thank you to the 160+ satisfied clients who entrusted us with their immigration matters during our first 10 months of business!

Knowing that we have so many happy clients already has given us further motivation to continue in our quest to change the status quo with respect to the delivery of immigration legal services. We look forward to providing a positive experience whilst achieving successful results for even more clients in the new year!
